Description of Service
Njiwa is an online marketplace that connects property owners/hosts ("Hosts") with individuals or businesses seeking to rent residential or commercial spaces ("Renters" or "Guests").
What we provide
Tools for listing properties, searching, booking, messaging, payments (where applicable), and basic property management.
What we are not
We are not a party to the rental contracts between Hosts and Renters, and we do not own, manage, inspect, or control any listed properties.
User Accounts & Responsibilities
All users must adhere to the following when using Njiwa:
All Users
Provide accurate, current, and complete information during registration.
Maintain the confidentiality of your account credentials and password.
Not misuse the service — including fraud, spam, harassment, hacking, posting illegal or inappropriate content, or violating any applicable laws.
Hosts
- Ensure listings are truthful and accurate.
- Only list properties that are legally rentable.
- Confirm you have the authority to list the property.
Renters
- Respect property rules and agreements.
- Pay agreed amounts on time.
- Not cause damage to any listed property.
Payments & Fees
Any payments — including booking fees, rent, deposits, and service charges — are handled directly between Hosts and Renters unless we explicitly offer a payment integration. We are not responsible for payment disputes, refunds, or chargebacks.
Direct payments
By default, all financial arrangements are made directly between the Host and Renter outside of Njiwa.
No liability for disputes
Njiwa is not responsible for any payment disputes, failed transactions, refunds, or chargebacks between parties.
Future platform fees
We may charge platform fees to Hosts or Renters in the future. Any such fees will be clearly disclosed in advance.
Limitation of Liability
To the maximum extent permitted by law, Njiwa and World Spring Softwares shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:
Disputes between Hosts and Renters
Any disagreements, conflicts, or legal issues arising between platform users.
Property condition, safety, or legality
We do not inspect or verify properties and cannot guarantee their safety or legal compliance.
Loss of data, profits, or opportunities
Any business or financial losses resulting from use or inability to use the platform.
Damages from platform misuse
Any damages caused by another user's misuse, fraudulent activity, or violations of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to conflict of law principles.
Applicable Law
The laws of the United Republic of Tanzania govern all matters relating to these Terms and your use of Njiwa.
Jurisdiction
Any disputes shall be resolved exclusively in the courts of Mbeya or Dar es Salaam, Tanzania.
